Salt Lake City, UT, July 2, 2022 (KUTV)

Prosecutors have declined to file charges against a man who shot two other men earlier this month at a Salt Lake City TRAX platform.

The shooting happened on July 2 at the 900 South 200 West TRAX station…

“The evidence clearly demonstrates that the suspect was approached on two separate occasions by one and later both individuals who were ultimately shot by the suspect. After the first encounter, one of the individuals clearly knew that the suspect was in possession of a firearm. Nonetheless, despite this knowledge, the evidence demonstrates both individuals approaching the suspect in an aggressive manner as he sat on a bench on the platform awaiting the train. As they approached the suspect, the suspect was pointing a firearm at them and repeatedly telling them to stop. The suspect backed up for several feet as they approached and fired a warning shot in an attempt to get the individuals to stop their aggressive approach towards him. Rather than deter the on-going approach towards the suspect, the video demonstrates the individuals increasing their speed of approach after the warning shot as the suspect is still walking backwards with an increased pace just before he shoots,” a Salt Lake County District Attorney’s Office declination letter states…

Anchorage, AK, July 11, 2022 (Alaska’s News Source, Anchorage Daily News)

A man is dead and another has been charged after a shooting that closed Klevin Street between Third Avenue and Fourth Avenue Monday night…

Hicks-Lundy said he was at a wake barbecue gathering in the neighborhood when he spotted Justin Austin holding a pistol and acting “like he was looking for trouble,” according to a statement of facts filed with the initial complaint by Anchorage police detective Troy Clarkin. He called 911 and reported what he saw, but police didn’t find the man when they arrived.

Hicks-Lundy said the other man followed him to the gathering and they exchanged words in front of the apartment building before the other man left, according to the document. But then the man and another man — the Austin brothers — “returned to his location and began shooting at him,” Clarkin wrote.

Hicks-Lundy said he tried to run away and fired back at the two men as they shot at him, the complaint states. He fired two shots as he ran down an alley and two or three more in front of a house before circling back to the wake location.

Shells and surveillance video were consistent with Hicks-Lundy’s interview, the detective said.

He told investigators “he was in fear for his life when (he) saw the male with the gun,” Clarkin wrote. “He was in fear that he and his family would get killed or injured when the male started shooting at him.”…

“The person responsible for the shooting has been interviewed by detectives,” police said. “Afterwards he was released, and no charges have been filed. The investigation is ongoing; no further details are available at present time.”
